Dirty D Charges Dropped

TAMPA, Fla. — The state attorney’s office has dropped all felony charges against porn producer Dirty D, XBIZ has learned.

Dirty D was arrested last March after Florida authorities charged him with two counts of the promotion of a sexual performance of a child, two counts of the use of a child in a sexual performance and one count of illegal computer pornography, which refers to the streaming of underage content.

“We dropped the charges because we had a lack of cooperation from the victim,” state attorney spokesman Mark Cox told XBIZ.

“It’s a good win,” Dirty D attorneys Bjorne Brunvand and A.J. Comparetto told XBIZ.

The legal team said it felt positive about the case from day one.

“A lot of hard work and a lot of time was spent investigating the legal argument,” the attorneys said.

“We were able to show it was a bad case for the prosecution and a good one for us.”

They said they were able to show prosecutors that there were factual problems with their case and that it wasn’t a case they needed to pursue.

“We came up with a great strategy and showed that this shouldn’t have been prosecuted in the first place,” Brunvand said.

The attorneys added Dirty D was confident from the beginning that with time and good defense the charges would be dropped.

The alleged victim had claimed that she was underage at the time of a Tampa Bay porn shoot in August 2007.

Dirty D told XBIZ last February that the woman — who goes by the porn pseudonym Kelsey Cummings, among others — had performed in numerous porn shoots with various adult producers "before and after" his shoot, and she even operates a blog that details her interest in working in porn and is married to a performer who has shot gay porn.

He denied her allegations, saying that her statements were "completely false and inflammatory."

"This is not the innocent, underage girl we are talking about," Dirty D said.

"She apparently used a fake ID. I have no idea why she's making these claims."

Brunvand and Comparetto said there is still an open issue that adult producers have to deal with.

“How do you know the girl showing you her ID is that girl?”

They said this issue remains a real concern among adult producers and are working on coming up with procedures producers can take to better protect themselves in the future.
